Lenders typically begin the foreclosure process when a homeowner is more than 60 days behind on mortgage payments. The lender will want the homeowner to catch up on all missed payments in what’s termed “reinstatement.” However, unless you have all of the arrears ready to be paid in one lump sum, the lender will continue with the next step of the foreclosure process, where the lender will retain counsel and file a Complaint in Mortgage Foreclosure against you. 


While you may think that there’s nothing you could do at this point, nothing could be further from the truth. The mortgage foreclosure process is a complex one and we use many different options and legal strategies in defending these actions. We will review the mortgage documents, the note, and the bank disclosures for any irregularities or errors.

We will hold the lenders feet to the fire in making them prove their case. Fighting a foreclosure often can, at the very least, give you additional time to stay in your home, while we explore other options, including a loan modification, short sale, deed-in-lieu, or Chapter 13 bankruptcy
